YOUR ARTWORK IS PRIVATE.
We at Hypersketch Pte. Ltd. (“Hypersketch”, “we”, “us” or “our”) take the privacy and confidentiality of your creative work seriously.
Hypersketch was created by designers who understand that sketches, concepts and unfinished ideas can be commercially or personally sensitive. We therefore design Hypersketch to minimise unnecessary collection of personal information and to limit the use of your creative content to providing the functions you request.
This Application Privacy Policy explains how information is handled when you use:
- the Hypersketch native application for iPad (“iPad App”); and
- the Hypersketch web application (“Web App”).
The two versions of Hypersketch store your artwork differently, as explained below.
This policy applies specifically to your use of the Hypersketch applications. General browsing of the Hypersketch marketing website may be governed by our separate Website Privacy Policy.
1. THE IMPORTANT DIFFERENCE BETWEEN THE IPAD APP AND WEB APP
iPad App
When you use the native Hypersketch iPad App, your saved Hypersketch artwork and project files are stored locally on your device, except where data needs to be temporarily sent for an online function such as AI generation.
Hypersketch does not ordinarily upload your entire locally saved project library to our cloud merely because you use the iPad App.
If you delete the application, erase the device, lose access to the device or otherwise remove locally stored files, Hypersketch may not be able to recover that artwork for you.
You may also choose to export, save, copy or share artwork using functions provided by your device or other applications. Once you intentionally send content to another application, service or person, their own privacy practices may apply.
Web App
The Web App works differently because your projects need to remain available when you return through a web browser.
Artwork and projects that you save using the Web App are therefore stored in Hypersketch-managed cloud storage.
Our primary cloud storage infrastructure for saved Web App projects is currently hosted using Amazon Web Services infrastructure in Singapore.
Saved Web App projects are retained so that you can return to and continue working on them.
At present, Hypersketch does not automatically delete saved Web App projects after a fixed period.
This persistent project storage is separate from temporary processing copies created when you request an AI generation.
2. ACCOUNT AND IDENTITY INFORMATION
The Web App requires an account so that we can authenticate you and provide access to your projects.
The principal identifying information required for normal account access is your email address.
Where practicable, Hypersketch uses a pseudonymous or hashed system identifier internally instead of repeatedly attaching your readable email address to application activity and creative content.
Pseudonymisation reduces the direct association between your identity and your creative work, but it does not mean that all account information is completely anonymous.
We do not require users to provide unnecessary information such as their home address, telephone number or date of birth merely to create artwork.
We may also process limited technical and account information needed to operate and secure the service, such as:
- authentication and login records;
- IP address;
- device, operating system or browser information;
- application version;
- subscription or account status;
- technical error and diagnostic information; and
- usage information relating to application functions.
We use this information for purposes such as authentication, security, troubleshooting, service operation, capacity planning and improving Hypersketch.
We do not use this information to build advertising profiles about our users.
3. YOUR CREATIVE CONTENT
Depending on the functions you use, creative content processed by Hypersketch may include:
- drawings and sketches;
- images;
- photographs or reference images you choose to provide;
- written prompts or instructions;
- project information;
- design settings;
- AI-generated or AI-modified images; and
- other material you intentionally place into a Hypersketch project.
We refer to these collectively as “User Content”.
Your User Content remains private unless you intentionally choose to share it, except for the limited processing and access described in this policy.
If you include personal information about yourself or another person inside a drawing, image or prompt, that information may form part of the User Content processed in order to provide the function you requested.
You should therefore avoid including unnecessary personal, confidential or sensitive information in AI prompts or uploaded material.
4. HOW AI GENERATION WORKS
Hypersketch provides a number of AI-assisted generation and image transformation functions.
Different generation functions may use different AI models and computing providers.
When you request an AI generation, the input required for that particular function - for example a sketch, image, prompt or relevant generation settings - must be transmitted to cloud computing infrastructure so that the requested computation can be performed.
The resulting image or other output is then returned to Hypersketch for your use.
This means that even when you are using the iPad App and your project itself is stored locally, the particular content you intentionally submit for an online AI generation must leave your device temporarily in order for that generation to occur.
5. TEMPORARY AI PROCESSING
Hypersketch currently uses serverless AI computing infrastructure for a number of generation functions.
For these functions, temporary processing files exist within the computing environment used to perform the generation. These computing environments are created and stopped dynamically according to demand.
Temporary data stored within this serverless processing environment is generally short-lived and is normally removed when the worker carrying out the generation shuts down.
Under our current operating configuration, this normally occurs within approximately one hour, although the exact period can vary according to workload and infrastructure conditions.
These temporary processing copies should not be confused with artwork that a Web App user intentionally saves to their persistent Hypersketch project.
6. GENERATIONS PROCESSED USING OPENAI
Certain Hypersketch generation functions use OpenAI API services.
Where an OpenAI-powered function is used, the content required for that generation is transmitted to OpenAI for processing.
Under OpenAI's applicable API data policies, API customer content is not used to train or improve OpenAI's models unless the API customer explicitly opts in to such use.
Hypersketch does not opt in to the use of User Content for OpenAI model training.
OpenAI may retain limited request, response or associated information in its security and abuse-monitoring systems for up to 30 days, in accordance with its applicable API data-retention policies, unless a different retention control applies or longer retention is required by law or necessary for security or safety purposes.
This OpenAI retention applies only to Hypersketch functions that are actually processed using OpenAI services. It does not mean that every Hypersketch AI generation is retained by OpenAI.
7. WE DO NOT USE YOUR WORK TO TRAIN AI MODELS
Hypersketch does not use your sketches, prompts, uploaded images, saved projects or AI-generated images to train, retrain or fine-tune our AI models.
We do not build AI training datasets from your artwork or classroom activity.
We do not intentionally provide your User Content to our service providers for the purpose of training their general-purpose AI models.
Where a third-party AI provider processes content for a requested Hypersketch function, that processing is undertaken to provide the service requested by Hypersketch, subject to the provider's applicable service and data-processing arrangements.
8. CLOUD STORAGE IS DIFFERENT FROM AI PROCESSING
It is important to distinguish between these two activities.
Web App project storage means keeping the artwork you have intentionally saved so that it remains available when you return to Hypersketch.
AI processing means temporarily sending the content required for a particular AI operation to specialised computing infrastructure so that the requested image or transformation can be generated.
A temporary AI-processing copy may therefore disappear while the resulting image remains permanently saved inside your Web App project.
For iPad App users, the resulting image may instead be downloaded back into the locally stored project on your device.
9. WHERE DATA IS STORED AND PROCESSED
Saved Web App project data is currently stored using Amazon Web Services cloud infrastructure located in Singapore.
AI processing may take place in other countries because Hypersketch relies on specialised computing infrastructure whose location can depend on the generation function being used and available processing capacity.
Our current AI infrastructure may involve processing in:
- Singapore;
- United States;
- Canada;
- Iceland;
- Norway; and
- Romania.
Current service providers include infrastructure and AI-processing services supplied by organisations such as Amazon Web Services, Runpod and OpenAI.
Processing locations and service providers may change from time to time as infrastructure, availability and the Hypersketch service develop.
Where information is processed outside your country, we take reasonable steps appropriate to the circumstances to use reputable service providers and protect the information in accordance with applicable privacy and data-protection requirements.
10. WHO CAN ACCESS YOUR ARTWORK
Hypersketch does not make your private artwork publicly available merely because you use the service.
Access to User Content within our systems is restricted to the extent reasonably necessary to operate, secure and support the service.
Authorised Hypersketch personnel may access information where reasonably necessary for purposes such as:
- investigating a technical problem;
- responding to a support request;
- maintaining the integrity or security of the service;
- investigating misuse or abuse;
- complying with applicable law; or
- operating infrastructure required to provide the service.
Our infrastructure and AI service providers may also technically process User Content to the extent required to provide their contracted services.
We do not permit our personnel to browse private User Content for unrelated purposes.
11. OWNERSHIP OF YOUR WORK
Hypersketch does not claim ownership of the artwork you create merely because it is created or stored using Hypersketch.
To the extent permitted by applicable law, you retain the rights you hold in the original material you create and submit.
Rights in AI-generated content can vary depending on the circumstances and the law of the relevant jurisdiction.
Hypersketch does not guarantee that an AI-generated image:
- qualifies for copyright protection;
- is unique;
- is sufficiently original to support an enforceable copyright claim; or
- does not resemble or infringe material belonging to another person.
You remain responsible for how you use, publish, reproduce or commercialise content generated through Hypersketch.
12. ANALYTICS AND SERVICE IMPROVEMENT
We may collect information about how Hypersketch is used, such as the frequency with which particular functions are used, generation activity, application performance, errors and general usage patterns.
We use this information to:
- operate and improve the application;
- identify technical problems;
- understand which functions are useful;
- maintain reliability and performance; and
- develop future versions of Hypersketch.
Where reasonably practicable, we use aggregated, pseudonymised or otherwise minimised information for these purposes.
We do not sell application usage data or use it for targeted advertising.
13. WE DO NOT SELL YOUR PERSONAL DATA OR ARTWORK
Hypersketch does not sell your personal information or artwork to advertisers, data brokers or other third parties.
We do not use your private artwork for targeted advertising.
We do not build commercial advertising profiles based on the content of your private projects.
14. SERVICE PROVIDERS
We use third-party service providers where necessary to operate Hypersketch.
These may include providers of:
- cloud hosting and storage;
- AI and GPU computing;
- authentication;
- application infrastructure;
- security;
- payment processing;
- communications;
- technical analytics; and
- customer support.
These providers may process information only to the extent relevant to the services they provide to us and subject to their contractual and legal obligations.
We may also disclose information where required by law, lawful governmental request, court order or where reasonably necessary to protect the security, rights or safety of Hypersketch, our users or others.
15. CHILDREN AND EDUCATIONAL USE
Hypersketch may be used in educational settings, including by children and young people.
Users under the age of 13 should use Hypersketch only with appropriate consent or authorisation from a parent, legal guardian, school or other responsible institution, as required by applicable law and the circumstances of use.
Where Hypersketch is provided through a school or educational institution, the school may provide additional information to students and parents about how Hypersketch will be used as part of the learning activity.
Hypersketch seeks to minimise the personal information required from student users.
We do not use student artwork or activity for targeted advertising or commercial profiling, and student User Content is not used by Hypersketch for AI model training.
Students should avoid entering unnecessary personal or sensitive information into AI prompts or uploaded content and should use Hypersketch in accordance with their teacher's instructions and their school's applicable technology policies.
16. DATA RETENTION
Different types of information are retained for different periods.
iPad App projects
Projects saved locally in the iPad App remain on the user's device until they are deleted or otherwise removed from that device.
Hypersketch does not control the lifecycle of purely local files after they have been stored on the user's device.
Web App projects
Projects saved in the Web App are retained in Hypersketch's cloud storage so that users can continue to access them.
At present, saved Web App projects are not automatically deleted after a fixed retention period.
Temporary serverless AI processing
Temporary processing files used for relevant serverless AI functions are generally removed when the processing worker shuts down and are normally short-lived.
OpenAI processing
Where an OpenAI API function is used, limited API information may be retained by OpenAI for up to 30 days under its applicable security and abuse-monitoring arrangements.
Account and operational information
Account, security, transaction, diagnostic and operational records may be retained for as long as reasonably required to operate the service, meet legal obligations, resolve disputes, prevent abuse and maintain security.
17. ACCESS, CORRECTION AND DELETION REQUESTS
Depending on applicable law and the information concerned, you may have rights relating to access, correction, deletion, restriction or other handling of your personal information.
You may contact Hypersketch regarding information associated with your account or to make a privacy-related request.
Because iPad App artwork may exist only on your own device, Hypersketch may have no copy of locally stored artwork and therefore may be unable to access, recover or delete it for you.
For Web App artwork stored in our cloud, you may contact us regarding deletion or other data-management requests.
Some information may need to be retained where required by law, for legitimate security purposes, or where otherwise permitted under applicable privacy requirements.
18. SECURITY
We use reasonable technical and organisational measures designed to protect information against unauthorised access, misuse, alteration, loss or disclosure.
These measures include limiting access to systems and information according to operational need and designing the service to minimise unnecessary association between identity and creative content.
However, no internet-connected service, cloud platform or electronic storage method can guarantee absolute security.
Users should also protect their accounts and devices, use appropriate authentication practices and avoid sharing account credentials with others.
19. PRIVACY LAWS
Hypersketch Pte. Ltd. is based in Singapore and manages personal data in accordance with privacy and data-protection requirements applicable to our activities, including Singapore's Personal Data Protection Act 2012 where applicable.
Where Hypersketch is offered to users in other jurisdictions, additional privacy and data-protection requirements may apply depending on the user, location and circumstances.
These may include requirements relating to children, educational institutions, international transfers and individual privacy rights.
Nothing in this Privacy Policy is intended to limit any privacy rights that cannot lawfully be excluded under applicable law.
20. CHANGES TO THIS PRIVACY POLICY
Hypersketch will continue to evolve, and our storage, AI models, infrastructure providers and application features may change over time.
We may therefore update this Privacy Policy when necessary.
Where we make changes, the revised policy will become effective when published, unless applicable law requires another form of notice or consent.
The “Last updated” date at the beginning of this policy indicates when this document was most recently revised.
If we make a material change to how we use or protect personal information or private User Content, we will take reasonable steps to provide appropriate notice.
